California’s court system handles thousands of cases each year involving domestic violence. It sometimes referred to as “family” or “intimate partner” violence. Some of those cases are handled in the criminal court system, while others proceed through the family or juvenile court system.
For a domestic violence case to proceed in family court, there must be an intimate relationship between the parties. This includes married or domestic partners, people who are dating or used to date, people who live or lived together, or people who have a child together.
The domestic violence laws say “abuse” is any one of the following:
1. Physically hurting or trying to hurt someone, intentionally or recklessly or;
2. Sexual assault or;
3. Making someone reasonably afraid that they or someone else are about to be seriously hurt (like threats or promises to harm someone) or;
4. Behaviors such as harassing, stalking, threatening, or hitting someone; disturbing someone’s peace; or destroying someone’s personal property.
